THE PLAYERS

These are the individuals involved in this particular case. Most of the names listed are of attorneys. Most of the attorneys listed were either court appointed or hired by each other to fight against Kyle.


Martha E. Ham
Born Martha Brusnahan. Wife to Donald Ham. Mother of Kyle Hamilton.

Kyle Hamilton
Kyle Orlemann
Daughter of Martha Ham and the second victim.

Jerry Orlemann

Kyle's husband. A Vietnam War vet who is 100% (service connected) disabled.


Mary "Jiggs" Kobek

Born Mary Brusnahan, Martha's sister. Jiggs and Martha were an excellent example of sibling rivalry. Jiggs once refered to Martha as "That bitch went after every boyfriend I ever had." Evidently Martha was successful on at least one occasion. Don Ham was engaged to Jiggs prior to marrying Martha.

At one time Jiggs had a power of attorney over Martha. During that period of time she liquidated an annuity (from Don's retirement) worth almost $100,000. There is still no trace of where the funds went.

Jiggs was anything but Martha's loving sister. She held a grudge against Martha from when Martha had their own mother admitted to a nursing home. Jiggs once said that Martha "should die penniless in a nursing home."

The last straw for Jiggs in this family relationship came when Kyle converted from Catholicism to a religion of which Jiggs disapproved. After that, Jiggs began a smear campaign against Kyle, telling her friends and some cousins that Kyle was a liar and a thief. One of the people she told was Ned Tonner.


Ned Tonner

Ned Tonner drew up all the original estate papers. He later colluded with Jiggs Kobek and Tonjua Gray to wrest control from Kyle. He had Martha sign court documents knowing full well that she was legally declared incompassitated. According to Detective Beier and the Prosecutor's Office, this is a Class D felony. Prosecution was declined because Mr. Tonner is also the City Attorney. His total billing to the trust came to
$9,019.94.


Richard O'Brien

Rich O'Brien represented Kyle in the initial guardianship hearing. Unfortunately, neither he nor Mr. Tonner, who advertises estate planning as his specialty, realized that only a competency hearing was required because the current powers-of-attorney nullifed the need for any guardianships. His total billing to the trust came to
$1,425.00.


Michael Riley

Mike Riley represented Kyle through much of the hearings to remove her from control. He said that he felt she was a nice person who got caught up in bad circumstances. He also told her that the judge considered her to be weird. Either from guilt or some other reason, Mr. Riley gave Kyle the name and contact information for an attorney specializing in malpractise suits and informed her that this attorney had beaten him before. His total billing to the trust came to
$8,672.45.


John Potter

John Potter was appointed guardian-ad-litum for Martha. He submitted a preliminary report filled with mis-statements, incorrect information, and what some believe were outright lies. His report also went into areas that were not within his purview nor that of the court (see Analysis of Guardian Ad Litim's Preliminary Report).

Potter was on the telephone with National City Bank at the same time that LaShuan Woods (see below) was on the telephone with her legal department. LaShuan then gave instructions to Kyle regarding the cashing of a check. Supposedly these instructions came from National City Bank's legal department, however, LaShuan has no recollection of who she spoke with in the legal department.

The following morning Potter notified the Rensselaer Police that Kyle had committed fraud against a financial institution.

One attorney representing Kyle has stated that he was approached by Potter who offered to make all the criminal charges against Kyle go away if she would drop all objections to the proposed payouts from the Trust funds.

Kyle's criminal defense attorney said that Potter told him that "their" strategy was to bankrupt her so that she could not pay for an attorney.

He submitted a bill for his time spent attending Martha's funeral.

His total billing to the trust came to
$15,018.05.


Richard Comingore

Richard Comingore, a member of the City Council, was appointed Guardian of both the Person and Estate, and Successor Trustee. He requested and received an emergency hearing to remove Kyle as Succesor Trustee by claiming that the hospital was getting ready to remove Martha due to non-payment of her hospital bill, a blatant lie since the President of the Hospital had already assured Kyle that there was no problem deferring billing while the legal matters were being settled. Mr. Comingore called Kyle early in the morning and told her "Your mother is dead." He further informed Kyle that he would have her arrested if she showed up for the funeral. He pushed to ignore repeated requests for an autopsy despite indications that Martha had fallen and injured her head during an argument with Mr. Comingore. He also billed the trust for attending Martha's funeral. His total billing to the trust came to
$15,504.75.


James Lakin

Represented Guardian-ad-litum John Potter in the first hearing to remove Kyle (???). His total billing to the trust came to
$520.00.
